The body of 60 year old Palestinian, Hamdan Tawfiq Arda, who was shot and killed by Israeli soldiers in al-Biereh city, in December, was released Friday.
Israeli authorities withheld the body of the slain civilian for 40 days, without a reason, reported WAFA. After 40 days, the Israeli military released the body to the family, at Salem military checkpoint, northeast of Jenin in the northern West Bank.
Following a raid in the central West Bank, Ramallah and al-Biereh Governorate, al-Arda, in his vehicle, was stopped by Israeli military forces. The Palestinian elder attempted to turn his vehicle around, which the Israeli soldiers viewed as an attempt at “ramming” the soldiers. The Israeli military opened fire at the man, hitting him in the head, with live ammunition.
Eyewitnesses said it was an “accident, with the driver surprised with Israeli soldiers in his way and attempted to turn away from them before they heavily opened fire at him.” The eyewitness accounts conflicted with the soldiers’ claims of intent to harm, forcing the army to change their statement.
The raid on al- Biereh, was an apparent attempt to locate the Palestinians responsible for the shooting death of 2 Israeli colonialist settlers on December 12. The settlers were killed close to the illegal Israeli Ofra settlement, built on Palestinian land, in the Ramallah and al-Biereh Governorate.
Approximately 85% of the Palestinians of the West Bank are Muslim, so it is important to note, that Islamic religious law calls for burial of the body as soon as possible.
According to WAFA, there are dozens of slain Palestinians being “withheld in Israeli mortuaries despite calls by human rights groups on Israel to release them.”

The Israeli intelligence returned the body of a 17-year-old slain Palestinian to his family in the Jabal al-Mukabbir village of occupied East Jerusalem, on Friday evening.
Sources told Ma’an that Israel returned the body of Abed al-Rahman Abu Jamal, 17, to his family at a checkpoint in Jabal al-Muabbir.
Abu Jamal was shot and killed by Israeli forces after he allegedly carried out a stabbing attack inside an Israeli police station in the village.
The family had denied the reports at the time, saying that Israel did not have any video footage proving that Abed al-Rahman did or attempted to carry out a stabbing attack.
Israel dramatically increased its policy of withholding bodies since the beginning of a wave of unrest across the occupied Palestinian territory in October 2015, although it has scaled back on the policy in recent months.
Israel has long had “cemeteries for the enemy dead,” also referred to as “cemeteries of numbers,” where Palestinians who died during attacks on Israelis are held in nameless graves marked by numbers.
Israel has attempted to negotiate the release of Palestinian bodies as well as several Hamas affiliates detained from the Gaza Strip in exchange for the bodies of two Israeli soldiers held by Hamas.
A joint statement released in 2016 by Addameer and the Israeli minority rights group Adalah condemned Israel’s practice of withholding bodies as "a severe violation of international humanitarian law as well as international human rights law, including violations of the right to dignity, freedom of religion, and the right to practice culture."
During his interview with Voice of Palestine, Arouri said that “Israel was the only country in the world that withholds the bodies of slain people for bargaining purposes or sets conditions on funerals for releasing them to their families.”

The Israeli authorities on Monday handed over the body of the Palestinian martyr Qasem al-Abbasi to his family in Occupied Jerusalem.
Quds Press said that al-Abbasi is set to be taken to his hometown, Silwan, and buried in Bab al-Rahma cemetery. video video
The news agency said that the Israeli police closed many roads in Ras al-Amud neighborhood and Silwan, and summoned reinforcements around the cemetery.
In the presence of the Palestinian Ministry of Heath's representative Dr. Ashraf al-Qadi, an autopsy conducted on the body of al-Abbasi at Abu Kabir Forensic Institute showed that he died of a bullet to the back that penetrated his lungs and aorta.
The Israeli occupation forces on Thursday opened fire at a Palestinian vehicle at Beit El checkpoint, northeast of Ramallah, killing al-Abbasi and injuring another Palestinian.
Al-Abbasi's family, following the incident, released a statement saying that their son was murdered, demanded a full investigation into the shooting, and called for an autopsy to be carried out.

Salwa Hammad, the coordinator of the Palestinian National Committee for Retrieving Bodies of Martyrs, said that Israel has decided to autopsy the corpse of Qassem al-Abasi, 17, who was killed by Israeli soldiers on December 20th, 2018.
Hammad said that Qassem’s corpse would likely be handed back to his family for burial Sunday.
Karim Jubran, the head of the field office of Israeli Information Center for Human Rights in the Occupied Territories (B’Tselem), said that the investigations Israel sometimes carries out after killing Palestinians cannot be trusted, and only aim at burying the truth.
He added that the experience B’Tselem had in similar previous cases revealed that Israel conducts these alleged investigations in order to prevent international parties and organizations from conducting them.
It is worth mentioning that the soldiers killed Qassem, and injured two others, after opening fire at their car near Beit El military roadblock, north of the al-Biereh city, in the central West Bank governorate of Ramallah and al-Biereh.
The army claimed that the driver of the car “broke through the military roadblock,” before the soldiers opened fire at the car, seriously injuring Qassem, who succumbed to his wounds.
Palestinian sources said Qassem was in a car transporting four Palestinians, all carrying Jerusalem ID cards, and just after arriving at Beit El military roadblock, the soldiers suspected that the car “was involved in a shooting” targeting a bus station on the colonialist road #60, close to Ofra illegal colony, east of Ramallah, although the distance between Ofra and Beit El is about 2 Kilometers, and the fatal shooting that killed Mohammad took place 40 minutes later.

The family of a slain Palestinian businessman has called on human rights groups to pressure the Israeli authorities to release the body of Hamdan al-Arida, who was cold-bloodedly killed by Israeli soldiers in al-Bireh city a week ago.
In a statement, the family said that Israeli forces unjustifiably shot dead Hamdan on a road in al-Bireh city as he was driving home from his company and detained his body.
The Israeli occupation forces on Thursday, December 13, shot dead Arida as he was driving his vehicle on a road during a raid on the industrial zone in the northern area of al-Bireh city in the occupied West Bank.
A number of eyewitnesses reported at the time that the incident had been merely a car accident, as the driver saw the unexpected presence of Israeli soldiers in his way and attempted to turn away from them before they opened fire at him.
Arida owned an aluminum factory in al-Bireh and hailed from Araba, a village near Jenin.

A human rights report has revealed that the Israeli occupation forces have killed 54 Palestinian children since the beginning of 2018.
A report released by Abdullah al-Hurani Center for Studies and Documentation said that 44 children were killed in Gaza border protests, and that the Israeli forces are still detaining the bodies of three of them.
The Center affirmed that the children, who were killed while taking part in peaceful demonstrations, did not pose any threat to the Israeli forces, while the latter deliberately targeted them with live fire.
The Israeli forces arrested 900 Palestinian children during the same reported period in the West Bank and Jerusalem, about 230 of whom are still held in Israeli lock-ups.
Abdullah al-Hurani Center said that Israel's systematic violations of the Palestinian children's rights have no end, noting that the latest of which was the high prison sentence imposed on 17-year-old Ayham Sabbah.
Israel's Ofer military court a few days ago sentenced Sabbah to 35 years in jail and imposed one million NIS fine on him for allegedly carrying out a stabbing attack in 2016.
The Center said that this harsh sentence violates the Convention on the Rights of the Child and the Convention against Torture signed by Israel in 1991.
It added that Israel's violations of the rights of Palestinian children are not limited to trials in military courts and high prison sentences; they start from the moment of arrest which usually takes place late at night during violent house raids that are accompanied by heavy firing of live ammunition.
The next stage is even worse. Lawyers and family members are not allowed to attend interrogation sessions where children are often handcuffed, blindfolded, beaten and insulted.
