The Israeli occupation forces (IOF) continue to hold the bodies of 40 male and female Palestinians, including children, who were killed by IOF gunfire over the past two months.
Mohammed Mahmoud, a lawyer for the families of martyrs, told the Palestinian Information Center that there is no Israeli law prohibiting the delivery of martyrs' bodies to their families, stressing that it is only a political issue, linked to the Israeli political level.
He pointed out that "the issue of the detention of 40 Palestinian bodies is a contentious issue between the ministers of the Israeli government; the internal security minister not only insists on detaining the bodies, but also demands the deportation of Palestinian families of martyrs to the Gaza Strip as punishment to the martyrs and their families, while the Israeli war minister Moshe Ya'alon rejects this, and says that he supports handing the bodies over to the families, we do not know if this contradiction is real or is a distribution of roles ".
Mahmoud confirms that their efforts regarding this issue are still "in the context of correspondence with the Attorney Generals of Israel and the Israeli police, but we did not go to the Supreme Court, so as to prevent any precedents or consequences."
A humanitarian issue
Lawyer and Jerusalem Affairs Adviser for the Palestinian Presidency, Ahmed Rwaidy, told the PIC that the issue “we are facing is a humanitarian issue in the first place."
He called on the families of the martyrs, international humanitarian institutions, and the Palestinian leadership to pressure Israel to deliver the bodies of the martyrs to their families.
Rwaidy explained that the official Palestinian action was on various levels; the political level through communication with consuls and international missions, in order to put a political pressure on the Israeli government to release the bodies to end this humanitarian issue.
Rwaidy added that among a group of files that have been handed to the US Secretary of State John Kerry during the meeting with president Mahmoud Abbas in Ramallah, a full file on that issue.
He pointed out that the Israeli occupation forces (IOF) want to take revenge on the martyrs' families.
Rwaidy continues: "It was agreed with the martyrs' families on the need to conduct autopsy on the martyrs’ bodies when delivered to the Palestinians so as to document the findings, and investigate the causes of the crime; as some of them were killed for no reason according to witnesses, photographs and video excerpts".
With regard to the legal level, Rwaidy said that there is a group of lawyers who follow up on the issue with families, and provide what is necessary on the legal aspect, but all these efforts were met with rejection by the Attorney General of Israel. Rwaidy opined that the Israeli security services do not refuse to hand over the bodies, but members of the Israeli cabinet insist on this inhumane punishment.
Rwaidy said that discussions were underway with international legal and human rights organizations to agree on international action against these Israeli practices at the international level, especially as this issue is of a human dimension and an issue of human rights.
The role of the masses
For his part, the lawyer Mohammed Alyan, one of those in charge of a national campaign to restore the bodies of the martyrs and the father of martyr Bahaa Alyan, said: "We have tried and still try to reclaim the bodies of the martyrs by sending petitions to the Israeli prosecution but the answer was that the detention of the martyrs' bodies is a political decision."
He added: "we called on the Palestinian Authority to exert pressure on the political level, but unfortunately no action has been carried out so far ... so our sole solution now is to activate the masses."
Alyan has posted on his page on the social networking site Facebook: "If the judiciary solution does not yield its fruits, and in the light of the silence on the political level, perhaps the hashtag #restoration_of_martyrs'_bodies, might be of benefit."
Martyr Hassan Manasra's uncle said: "This is painful for us and for other martyrs' families... we believe that the right place of martyrs' bodies is graves not refrigerators."
Martyr Thaer Abu Ghazaleh's grandfather said: "by this practice the Israeli occupation authorities are punishing both the dead and the living ... Why didn’t they release the body of our martyrs? What's the use of detaining dead bodies? Don’t they know that the detention of martyrs' bodies angers the people of the martyrs and leads to results contrary to what they want ?!".

The Israeli Occupation Forces (IOF) stormed Monday morning two martyrs’ homes in Nablus, north of the West Bank, and carried out a number of arrests in the city.
Eyewitnesses told the PIC reporter that IOF violently stormed and searched the houses of the two martyrs Alaa Hashash and Ashraqet Qanani.
The martyrs’ family members were investigated during the raid, the sources added.
"The Israeli soldiers threatened to demolish our house in the coming days", Qanani’s father said.
Meanwhile, Hashash’s family said that Israeli forces informed them of their intention to release their son’s body within two days.
During the raid, IOF arrested three youths from the city and took them to unknown detention center.
On the other hand, Israeli forces carried out a similar raid campaign throughout al-Khalil city, south of West Bank.
Several local youths were arrested while a number of checkpoints were erected during the campaign.
Four youths were detained in Beit Ummar town, while several Palestinian vehicles were stopped and searched at a make-shift checkpoint at the entrance to Samu town.
IOF soldiers have also closed the entrance to Fawar refugee camp with cement blocks, forcing the local residents to use alternative roads.
Also in al-Khalil, Israeli forces were deployed near a local secondary school in the Old City and opened fire at its students. At least one student was injured in his foot.

Dozens of Palestinians marched Sunday night in the funeral of the 17-year-old slain Jerusalemite Ayman Abassi, who was shot and killed by Israeli Occupation Forces (IOF) earlier Sunday, amid calls for revenge.
The slain teen’s mother said during the funeral that her son was shot in his chest as clashes erupted in Silwan town in occupied Jerusalem.
"Ayman was my youngest son", the mother said while holding his picture. He was earlier arrested by Israeli forces, she continued.
Israeli forces were deployed in the town and in surrounding areas of the slain teen’s house in Ras al-Amoud neighborhood and tried to take away his body but failed.
A local medical center was also violently stormed during the IOF raid in a failed attempt to find the body.
Local youths managed to take the body from the medical center before arrival of the Israeli soldiers fearing that his body would be stolen similar to the case of dozens of martyrs’ bodies since the outbreak of the Jerusalem Intifada, and brought it to his house before being buried at night in a nearby cemetery.
Following the funeral, clashes erupted in the nearby neighborhood of Ein al-Lozeh where Molotov cocktails were thrown at Israeli patrols.
Israeli forces also used live and rubber bullets, causing a number of casualties. One of the injured youths was taken to hospital in critical condition.
Ayman, who had previously spent 18 months in Israeli jails and a further 10 months under house arrest, was the second Palestinian to be killed by Israeli gunfire on Sunday.
Following Ayman’s killing, Palestinian national forces in occupied Jerusalem stressed the need for escalating resistance operations against Israeli targets, calling for “a day of rage” on Monday.

Two Palestinian families organized a protest vigil in Jenin on Tuesday to demand the return of their two sons’ bodies after being killed at Israeli roadblocks in two separate incidents.
Local human rights institutions and activists participated in the protest and chanted slogans calling for the release of the Palestinian martyrs’ bodies.
As part of its mass punishment policy against the Palestinians, the Israeli authorities still refuse to release the bodies of 32 martyrs, who were shot and killed by Israeli gunfire during clashes or alleged attacks on Israelis.
Analysts said that Israel's detention of Palestinian dead bodies was aimed at affecting the course of events and making the Palestinian youths think twice before rising up against it.

As part of its mass punishment policy against the Palestinians, the Israeli security authorities still refuse to release the bodies of 32 martyrs, who carried out recent heroic counterattacks against Israelis.
The Israeli occupation forces had released 11 dead bodies of Palestinians since the outbreak of al-Quds intifada (uprising) in early October, but they refused to release 32 others, according to a report released on Monday by Al-Quds Center for Israeli and Palestinian studies.
Director of the center Alaa al-Rimawi said that Israel's detention of Palestinian dead bodies was aimed at affecting the course of events and making the Palestinian youths think twice before rising up against it, pointing out that such measure had been used during the first and second intifadas (uprisings).
Rimawi expressed his belief that Israel's persistence in detaining the bodies of Palestinian martyrs would only lead to more resistance attacks and activities against it.

Defense for Children International – Palestine has confirmed that Israeli forces have killed 16 Palestinian children in separate incidents across the occupied West Bank, including East Jerusalem and the Gaza Strip, since the beginning of October.
The number of Palestinian children who have killed since the beginning of this year amounts to 21, Al Ray reports.
DCI-Palestine confirmed that 16 Palestinian children were killed between October 5 to November 10, 14 of whom were killed by live fire.
The movement reported that Israeli occupation authorities are still holding the bodies of six children who have been identified as Eshaq Badran, Mustafa al- Khateeb, Hasan Manasrah, Mutaz Auwesat, Ahmed Abu Rub and Sadeq Ghurebia.
It was also documented that Israeli forces killed three children in one day (October 17): Tareq Annatsha, Bayan Asaliya and Mutaz Auwesat.
272 children were also reported injured by Israeli forces, since the beginning of October.
The director of investigation for DCI-Palestine, Aayd Abu Qutesha, refuted the claims of Israeli soldiers who said that these children were killed for carrying out stabbing attacks, explaining that the military could use alternate methods without resorting to live fire. He added that this type of killing is considered extrajudicial.
He pointed out that seizing the bodies of the children is, in fact, a collective punishment against their families, who were also deprived the right to anatomize their bodies.

Hamas spokesman Husam Badran said Israel's withholding of 31 Palestinian martyrs’ bodies is a crime that needs a strong response from resistance.
In a statement on Thursday, Badran said the anti-occupation stabbing operation carried out in Tel Aviv on Thursday proves that the Palestinian people insist on challenging Israeli measures which deprive them of their right of arranging funerals.
Badran hailed the stabbing operation and called on Palestinian youths to carry out more resistance actions, saying that such high-quality operations will force Israeli authorities to turn in martyrs’ bodies to their families and people.

Palestinian medical sources in Jerusalem have reported Friday that Israeli soldiers assaulted dozens of nonviolent protesters marching in Jabal al-Mokabber, in occupied Jerusalem, causing dozens to suffer the effects of tear gas inhalation. The Palestinians marched demanding Israel to transfer the bodies of eleven slain Palestinians.
The Palestinians are also demanding Israel to end its deadly siege on their neighborhoods and communities, in different parts of occupied Jerusalem, after the army blockaded them with concrete blocks, and dozens of roadblocks.
They are also demanding the Israeli Authorities to allow the transfer the remains of ten Palestinians from Jerusalem, who were killed by the army in previous attacks, and to void the orders for the destruction of their families’ homes, as such measures are collective punishment, illegal under International Law and the Fourth Geneva Conventions.
Adnan Gheith, Fateh Secretary in Occupied Jerusalem, said the Palestinians have the right to bury their dead in proper ceremonies, and will not stand idle while Israel continues to demolish homes, and destroy the lives of entire families.
Gheith added that the Palestinians would always oppose and resist all attacks and invasions into the Al-Aqsa Mosque, and warned that ongoing violations and provocative tours by Israeli fanatics and soldiers into Al-Aqsa, will only lead to further clashes and tension.
The slain Palestinians Israel is still refusing to transfer their remains are:
1. Mustafa al-Khatib, Jabal al-Mokabber – killed on October 12, 2015.
2. Baha ‘Oleyyan, Jabal al-Mokabber – Killed on October 13, 2015.

The human rights unit of the Palestinian ministry of interior affairs has strongly denounced the international silence on Israel's detention of dozens of Palestinian martyrs' bodies.
In a press release on Sunday, the unit's legal advisor Alladdin al-Aklouk condemned Israel's detention of Palestinian dead bodies as a "heinous and shameful crime against humanity."
"Such disgraceful act will be a stain on the forehead of those who are able to stop this crime, but they remain passive and silent," Aklouk stated.
The Israeli occupation authorities are holding, with no regard for the international law, several bodies of Palestinian martyrs, who were killed extrajudicially by its military and security forces.
